Attorney Jon Saia Interviewed in 10TV News Story and Featured As Presenter at Seminar

In the news story, 10TV News interviewed Attorney Saia about substandard work performed by a criminalist for the Ohio State Highway Patrol Crime Lab, which impacted the outcome of an OVI (or DUI) case the lawyer personally handled. Because of the lab protocol violations that occurred, Attorney Saia’s client, who had four previous OVI convictions, was able to get a light sentence for an alleged fifth OVI offense that resulted in a bicyclist’s death. Attorney Saia noted that the crime lab problems made it possible for his client to enter a plea for an OVI charge, which led to a sentence of 30 days in jail rather than up to a year in jail. Mr. Saia explained in the interview that when there are lab errors, the evidence is considered compromised and has to be thrown out.
According to the news report, an internal investigation showed that the criminalist had violated various protocols at the crime lab. Evidence had surfaced that she had carried out the following actions: listed the incorrect assignment date on dozens of drug screens; waited several days to document the transfer of samples; reported using a testing substance that had already been exhausted; and recreated and backdated a daily status report that she had previously destroyed.
In addition to sharing his legal insight in the media, Attorney Saia also recently shared his professional knowledge by conducting a presentation at a DUI seminar. The 8th Annual Driving Into a DUI seminar was held in Key West, Florida on February 20, 2014. He specifically shared on the topic of “Drug Recognition, Evaluation and Classification of Drugged Driving Cases.”
