Canada's Anti-Spam Legislation (CASL) - More Than Meets The Eye

Unsolicited commercial electronic messages "spam" represents over 80% of all email traffic. It’s an economic drain on businesses and negatively impacts personal productivity. CASL was tabled as Bill C-28 on May 25, 2010 and was granted Royal Assent on December 15, 2010. The legislation is intended to deter spam and other damaging and deceptive electronic threats such as identity theft, fraud and spyware from occurring in Canada. According to Martha Healey, Partner at Norton Rose Fulbright Canada LLP, the legislation is far reaching and will have sharp teeth. There are strict requirements for obtaining consent and USA businesses who email into Canada may also need to be compliant.
“Bring your house in order before the legislation comes into effect. Forget about pre-checked boxes. The more you can do to make your consent clear the better off you will be. If you’re buying emails from a list broker make sure to check into how they are collecting their data and how they obtained consent,” said Healey, noting that it could be very difficult to establish that a purchased email list meets the consent requirements under CASL.
If you’re like most companies, you probably send 1000s of emails to your database each month. Make sure that you have good systems and processes in place to obtain proper consent. If not, you could be in violation of CASL and the possible penalties are significant including administrative monetary penalties of up to $1,000,000 for an individual and up to $10,000,000 for a corporation.
CASL underscores the importance of taking a more structured approach to information management. Consider all the different sources of customer and prospect interaction. Make sure that your data gets standardized, cleansed and de-duped. You should also continue to add new data using email, social media and tele-prospecting. Now is a perfect time to take a step back and review your processes and business rules on how you conduct your marketing programs.
