Keegan & Novick Secures Not Guilty Verdict in Challenging DUI Case
Boston, MA (PRWEB) March 13, 2014 -- States throughout the country have increased efforts to arrest, prosecute and harshly penalize individuals who drive under the influence of alcohol or drugs. As such, these cases are often difficult to litigate, especially when aggravating circumstances and significant evidence are stacked against defendants. For the Boston criminal defense lawyers at Keegan & Novick, experience and determination have proven to be the attributes that can overcome these challenges.
In a recent case handled by the firm – Docket # 2010MI-1368, Middlesex County, MA – the legal team was representing a client who was charged with a 4th DUI / OUI offense. Given his criminal background, the client faced a mandatory two and half year term of imprisonment if convicted. Stakes in the case were further elevated by the evidence against the firm’s client.
Not only was Keegan & Novick’s client facing serious allegations, evidence heard by the jury presented a troubling picture. According to court documents, the jury heard evidence about a pedestrian who suffered serious injuries before the firm’s client’s pickup truck collided with an oil truck in a construction area near the roadway. Two construction crew members stepped forward as witnesses to identify the firm’s client. Additionally, they testified that they saw the client behind the wheel after the accident, that they witnessed him trying to leave the scene, and that they forcefully removed him from the driver’s seat before authorities arrived.
Fortunately for the firm’s client, Attorneys Joseph Keegan and Stephen Novick are both former police officers with experience in crime scene investigations. As a result of their independent investigation, they were able to illicit from two witnesses that their client was in the passenger seat and that he made no attempts to flee to scene. After several hours of deliberation, the jury returned a not guilty verdict.
