RI DUI Lawyer Robert H. Humphrey Lectures on DUI & Refusal Cases for RI Bar Association

Humphrey, was asked by the Rhode Island Bar Association to lecture all the lawyers of the State of Rhode Island on the successful detection, prosecution and defense of drunk driving and refusal to submit to a chemical test cases. The March of 2014 DUI and Refusal Cases Continuing Legal Education (“CLE”) Program is part of the DUI and Refusal Cases: Beyond the Basics series of lectures and articles the Law Offices of Robert H. Humphrey is conducting for the Rhode Island Bar Association. This most recent drunk driving and Refusal cases CLE marks the sixteenth (16th) year the Rhode Island Bar Association has tapped Attorney Humphrey’s expertise in the field of the DUI and Refusal defense. For over twenty (20) years, Attorney Humphrey has been publishing articles and lecturing for the Rhode Island Bar Association on the topic of DUI defense. Attorney Humphrey stated that “I consider it a great honor to once again have the opportunity to share my DUI and Refusal cases courtroom experience with my fellow Rhode Island attorneys.”
The CLE Program focused on the detection, prosecution and defense of DUI and Refusal cases from the initial police contact with the suspect through the trial and disposition of the case. The Program consisted of two (2) distinct three (3) hour sessions.
The morning session provided a comprehensive nuts and bolts analysis of DUI and Refusal cases and focuses on the basics of DUI and Refusal cases. This session was taught from the perspective of a municipal prosecutor, defense attorney and police officer. The morning session included the following:
1. Basic components of a DUI case;
2. Basic components of a Refusal case;
3. Demonstration of standardized field sobriety tests;
4. Prosecution of a DUI case; and
5. Defense of a DUI case.
The afternoon session moved beyond the basics of DUI and Refusal cases. In the afternoon session, Attorney Humphrey had guest speakers including a representative from the Department of Attorney General, a representative from the Department of Health, and a Drug Recognition Expert. The afternoon session included the following:
1. Certification of breathalyzer operators and breathalyzer machines;
2. Prosecution of a Refusal case at the RITT;
3. Issues beyond the basics of DUI cases;
4. Issues beyond the basics of Refusal cases;
5. Confrontation Clause and blood testing; and
6. Drug Recognition Expert.
Attorney Humphrey’s article entitled 6th Amendment’s Confrontation Clause Evolution which was published in the March/April 2013 edition of the Rhode Island Bar Journal was reviewed to determine how blood test results in drunk driving cases can be suppressed based on the Confrontation Clause.
Throughout both sessions, important cases, typical scenarios and practice pointers for both DUI and Refusal cases were analyzed and attendees received the 2014 DUI Practice Manual which is widely used by drunk driving law practitioners in courtrooms throughout the state. This program included both new and experienced attorneys. Of great significance is that this CLE program was the first time a Rhode Island Bar Association CLE seminar has been nationally recognized and this CLE Program has been approved by the National College for DUI Defense (“NCDD”) to meet its membership rules requirement.
