On February 25, 2014, the San Francisco employment attorneys at Blumenthal, Nordrehaug & Bhowmik filed a class action lawsuit against Price-Simms, Inc. alleging that the new and used auto dealer violated the rights of on-site Service Technicians under the California Labor Code. The class action lawsuit against Price-Simms for alleged unpaid wages and missed meal periods is currently pending in the Santa Clara Superior Court, entitled Vogel v. Price-Simms, Inc., Case No. 1-14-CV-261268.

The class action complaint filed against Price-Simms by the San Francisco labor lawyers at Blumenthal, Nordrehaug & Bhowmik alleges that the auto dealer inaccurately records the actual number of hours worked and as a result fails to pay the Service Technicians the correct amount of minimum wages and overtime compensation. The complaint asserts that the Service Technicians accrue flag hours only when working on a repair order and that while these employees wait for work to be assigned to them they perform various non-repair tasks but are allegedly not allowed to flag these hours. As a result, the Complaint alleges the Service Technicians are forced to work many uncompensated hours. The Complaint also asserts a claim under California's meal and rest period laws for Price-Simms' alleged failure to provide full off-duty thirty minute uninterrupted meal periods to its Service Technicians.
