Attorney Jon Saia Gets Client Dismissed and Acquitted of OVI and Weapons Charges
Columbus, OH (PRWEB) March 21, 2014 -- With the help of Columbus OVI Defense Attorney Jon J. Saia, a man who was accused of drunk driving and improper handling of a firearm was able to fully avoid conviction. The man was facing four criminal counts, but he was able to get two dismissed and the other two cleared through a trial verdict of Not Guilty. (Franklin County Court of Common Pleas, Franklin County, Ohio - Case No. 2013 CR 372)
According to court records, Attorney Saia’s client was facing charges following an incident in which he was found asleep at the wheel after getting a flat tire. The client was woken up by a law enforcement officer. While the man was searching for his driver’s license, the officer saw a handgun in his vehicle console, according to court documents.
The records show that the officer then tried to get the man to participate in OVI testing to determine whether he was operating a vehicle while under the influence of alcohol or drugs. The man refused to submit to standardized field sobriety tests, though he was later given a blood test due to the issuance of a search warrant. Court documents state that the blood test results indicated that the man’s blood alcohol concentration was 0.134%, which is well above the legal limit of 0.08%. As a result of this incident, the client was indicted with two counts of OVI and two counts of improper handling of a firearm.
According to court records, Attorney Saia advocated for his client in pre-trial motion hearings and one OVI charge and one weapons charge were dismissed. The lawyer went on to present the client’s defense before a jury.
After about one hour of deliberations, court documents show that the jury returned with a verdict of Not Guilty for the remaining two charges. Due to Mr. Saia’s effective legal representation, the man is now able to avoid convictions that could have negatively impacted his life. OVI and weapons convictions can result in penalties such as incarceration, probation, fines and driver’s license suspension.
Attorney Saia has been practicing law for more than two decades. In addition to OVI, he also focuses his legal practice on traffic offenses and general criminal defense. Mr. Saia is well-trained on the topic of OVI testing, which strengthens his ability to challenge the results of such tests in OVI/DUI cases. He is a certified instructor on standardized field sobriety test administration, and he is certified in the operation, diagnostic verification and calibration of BAC Datamaster Breath Alcohol Testing Instruments.
