On January 31, 2014, the U.S. Food & Drug Administration (FDA) announced it had launched a safety review of drugs like AndroGel, after two studies indicated that testosterone therapy might increase the risk of heart attacks, strokes and death in older men or men with pre-existing heart problems. One study, which involved 8,000 men treated by Veterans Administration linked testosterone therapy to a nearly 30% increased risk of heart attack stroke and death. The second study reported an increased risk of heart attack in older men, as well as in younger men with pre-existing heart disease, who underwent testosterone therapy.

According to a report published by Bloomberg.com, five men filed AndroGel lawsuits within days of the FDA’s announcements. All of the claims are now pending in U.S. District Court, Northern District of Illinois, and allege that AndroGel caused the men to suffer heart attacks, strokes, and/or heart failure. The AngroGel lawsuit plaintiffs further allege that the marketing tactics used to drive sales of the mediation amounted to “disease mongering,” and caused many men to seek treatment with AndroGel despite having no medical need for the drug. They also accuse AbbVie, Inc. and other defendants of downplaying the drug’s risks, and of concealing knowledge that AndroGel had a “serious propensity” to harm. (Aurecchia v.
