Connecticut Attorney Heath D. Harte Releases Statement on New Comment to ABA Model Rule 1.1

Harte, an attorney and member of both the Connecticut and New York state Bar associations, released a statement today about the new provisions to ABA Model Rule 1.1 mandated by Comment #8. Comment #8 was appended to ABA Model Rule 1.1 by the American Bar Association of August of 2013.
In broad terms, ABA Model Rule 1.1 states that an attorney must be competent as they represent their client to the best of their ability. The comments to the rule function as amendments that clarify and delineate exactly what maintaining competence means.
According to the American Bar Association (Client-Lawyer Relationship Rule 1.1 Competence - Comment, 2013) the recently added Comment #8 states that “To maintain the requisite knowledge and skill, a lawyer should keep abreast of changes in the law and its practice, including the benefits and risks associated with relevant technology, engage in continuing study and education and comply with all continuing legal education requirements to which the lawyer is subject.”
Heath D. Harte took some time to comment and reflect on the new provisions to ABA Model Rule 1.1.
“As attorneys, we owe it to our clients and ourselves to maintain competence on the all of the latest technology, as least as it applies to legal representation,” said Heath D.
