Connecticut Attorney Heath D. Harte Releases Statement on New Comment to ABA Model Rule 1.1

Heath D. Harte, Attorney at Law, released a statement today commenting on the new provisions for ABA Model Rule 1.1 that were mandated by the recently appended “Comment #8.” Comment #8 states that a lawyer must maintain competence in regards to technology as they represent their clients.

Heath D. Harte, an attorney and member of both the Connecticut and New York state Bar associations, released a statement today about the new provisions to ABA Model Rule 1.1 mandated by Comment #8. Comment #8 was appended to ABA Model Rule 1.1 by the American Bar Association of August of 2013.

In broad terms, ABA Model Rule 1.1 states that an attorney must be competent as they represent their client to the best of their ability. The comments to the rule function as amendments that clarify and delineate exactly what maintaining competence means.

According to the American Bar Association (Client-Lawyer Relationship Rule 1.1 Competence - Comment, 2013) the recently added Comment #8 states that “To maintain the requisite knowledge and skill, a lawyer should keep abreast of changes in the law and its practice, including the benefits and risks associated with relevant technology, engage in continuing study and education and comply with all continuing legal education requirements to which the lawyer is subject.”

Heath D. Harte took some time to comment and reflect on the new provisions to ABA Model Rule 1.1.

“As attorneys, we owe it to our clients and ourselves to maintain competence on the all of the latest technology, as least as it applies to legal representation,” said Heath D. Harte. “While technology in this day and age seems to be in a constant state of rapid evolution, that is no excuse for a lawyer not keeping abreast of any technological changes that could potentially affect the representation of a client. It is our duty to make sure that our clients receive competent legal representation. With the addition of comment 8, it is clear that fulfilling that duty now entails a thorough knowledge of current technology, and any potential legal pitfalls that may arise from its use, either by a client or the attorney representing them.”
