A lawsuit has been filed against the largest broad-line retailer by two assistant store managers asserting they were improperly classified as exempt from overtime pay

The retail company allegedly misclassified their Assistant Store Managers, and as a result allegedly failed to pay these employees overtime.

On January 29, 2014, the San Diego employment law lawyers at Blumenthal Nordrehaug & Bhowmik filed a class action complaint seeking overtime pay against Sears, Roebuck & Co. alleging the retail company misclassified their Assistant Store Managers and as a result allegedly failed to pay these employees overtime wages. Lucero, et al. vs. Sears, Roebuck & Co., Case No. 37-2014-00000431 is currently pending in the San Diego County Superior Court for the State of California. The lawsuit claims that the Assistant Store Managers spend most of their time engaging in non-exempt labor for Lowe's, including, working the retail registers, greeting customers, taking inventory counts, and receiving product shipments among other things. The Complaint also states that the Assistant Store Managers spend almost no time managing other employees working for Sears. As a result, the lawsuit alleges that the Assistant Store Managers should be paid overtime wages and provided with the legally required thirty minute uninterrupted meal periods.
