The lawsuit claims that the Assistant Store Managers spend most of their time engaging in non-exempt labor for Lowe's, including, working the retail registers, greeting customers, taking inventory counts, and receiving product shipments among other things. The Complaint also states that the Assistant Store Managers spend almost no time managing other employees working for Sears. As a result, the lawsuit alleges that the Assistant Store Managers should be paid overtime wages and provided with the legally required thirty minute uninterrupted meal periods.
