San Antonio Law Firm Teams Up with Attorney Bringing Bexar County's First Same-Sex Divorce Case
San Antonio, Texas (PRWEB) April 09, 2014 -- On February 18, 2014, the Petitioner known as A. L. F. L, filed for divorce in Cause Number 2014-CI-02421, in Bexar County, Texas, from her wife, K. L. L. The parties were married on August 13, 2010, in Washington D.C., which recognizes same-sex marriage.
The parties together had one child during their marriage.
The Respondent filed a Plea to the Jurisdiction and Motion to Dismiss, arguing that Petitioner did not have any standing to bring her divorce action because Texas does not recognize same-sex marriage, and thus, cannot grant a divorce arising out of a same-sex marriage.
On March 25, 2014, The Whitley Law Firm, P.C., filed its Notice of Appearance as co-counsel to Judith Wemmert.

On March 27, 2014, Whitley made oral arguments regarding the standing of the Petitioner to bring her divorce action. The Honorable Barbara Nellermoe is withholding her ruling until briefs on the issue, due April 11, 2014, are submitted by the attorneys.

This case was brought on the heels of the recent decision by the Honorable Orlando Garcia, in De Leon, et. al. v. Rick Perry, et. al.. In De Leon, the Court held that Texas’ ban on same-sex marriage, and its refusal to recognize out-of-state same-sex marriages, is unconstitutional. The case is now pending in the Fifth Circuit Court of Appeals.
