Connecticut Lawyer Heath D. Harte Comments on Report that New London Police are not complying with an Updated Racial Profiling Law

Connecticut attorney Heath D. Harte released a statement today commenting on a report that the police department in New London, CT does not comply with the state’s updated anti-racial profiling law. The law in question prohibits law enforcement officers from stopping, detaining or searching a motorist when the stop is motivated by the race, color, ethnicity or sexual orientation of the driver.

Heath D. Harte, an attorney at law licensed to practice by the Connecticut and New York State Bar Associations, released a statement today commenting on reports that the New London, CT police department has been non-compliant with an updated racial profiling law that prohibits law enforcement from searching, stopping, or otherwise detaining a motorist based solely on their race, color, ethnicity or perceived sexual orientation.

According to a report from the Boston Globe (New London seen not complying with profiling law, 3/23/2014), the New London Police Department has only recently updated the way it collects data on traffic stops, and has yet to take advantage of new technology to transfer that data to the Criminal Justice Information System.
According to the report, officials at the New London Police Department have said that they are collecting more data than is necessary, but their outdated computer system has prevented them from sending that date to the Criminal Justice Information System, as is mandated by law.

“While it is possible that obsolete computers are the root of the issue, they are no excuse for an entire Police Department falling out of compliance with a very serious, state mandated law that protects the personal freedom of a significant portion of the people of Connecticut,” said Heath D. If one department is found to be non-compliant, it calls the integrity of the rest of the data-collection program into question. Those kinds of questions cast a pall on the entire state justice system, which is a poor outcome for everyone in the state, not just defendants and their attorneys.”
