Houston, TX (PRWEB) May 12, 2014 -- Case # 1871421 in the Harris County Criminal Court at Law No. 3, completed on April 16, 2014, was Mark Thiessen’s sixth not guilty verdict where the blood test was admitted as evidence. The jury did not accept the results as reliable or accurate. Thiessen’s client was asleep in the middle of an intersection in Midtown. When HPD knocked on his window, he put his car in drive and drove for approximately 25 blocks through Midtown and into Downtown Houston. After the client was arrested and handcuffed, a Sergeant with HPD performed the HGN test on the client. According to court records, the Sergeant testified under oath that he looked for distinct and sustained nystagmus first and then messed up on the prescribed timing of the HGN test. According to court records, this same Sergeant also testified that marijuana and muscular sclerosis caused HGN, when in fact they do not. HPD then withdrew his blood and the result was received in evidence of a 0.119. The State absolutely could not prove a blood test case beyond a reasonable doubt. Furthermore, questionable ASCLD protocol and equipment in the lab called the evidence into question.
