Heath D. Harte, an attorney-at-law with over twenty-five years of experience, released a statement today commenting on retired U.S. Supreme Court Justice’s comment on marijuana prohibition.

Recently, retired U.S. Supreme Court Justice John Paul Stevens commented that future generations will view the prohibition against marijuana to be similar to that against alcohol in the early 20th century as a mistake not worth the cost, according to the ABA Journal*.

“The recent comments from retired Justice Stevens serve as an interesting talking point for defense lawyers. Opening up the conversation and comparing prohibition against marijuana to that against alcohol in the early 20th century could be a successful approach for alternative sentencing or sentencing appeals,” stated Heath D. Harte.

Retired Justice Stevens recently published a book titled, “Six Amendments: How and Why We Should Change the Constitution”. The book covers a variety of topics including the end of capital punishment and limiting gun rights. Stevens retired in June 2010, but more recently has been stirring controversy with his latest book, according to the ABA Journal.

“In the future, defense attorneys can utilize Justice Stevens’ comments in argument for an alternative sentencing or for appeals. As more states begin to legalize the use of marijuana and other noteworthy figureheads speak out regarding the prohibition of marijuana, defense attorneys will be able to utilize this information for negotiation tactics,” continued Harte.
