Attorney Bret Lusskin of Aventura, Florida has obtained a $63,000.00 summary judgment against debt collector Diversified Consultants, Inc., for violation of the Telephone Consumer Protection Act (TCPA). Diversified Consultants was ordered to pay $63,000.00 to Angela Lardner of Miami, Florida for violating her rights by illegally placing over a hundred automated collection calls to her.
According to court records, in 2011, Diversified Consultants began placing the unlawful calls to Ms. Lardner’s cellular telephone. The company was attempting to collect a T-Mobile bill, although Ms. Lardner strenuously disputed the bill. Lusskin filed a federal lawsuit on Ms. Lardner’s behalf on August 1, 2013, alleging Diversified Consultant’s violations of the TCPA. (Lardner v. Diversified Consultants, Inc., Florida Southern District Court, Case No. 1:13-cv-22751-UU).
On May 1, 2014, the Honorable Judge Ursula Ungaro found that Diversified Consultants placed 126 unlawful calls to the Plaintiff’s cellular telephone. These calls were made using prohibited technology, including an automatic telephone dialing system and an artificial or prerecorded voice. Under federal law, such calls are illegal unless placed with the prior express consent of the called party.
“The law couldn’t be any clearer,” says Lusskin. “It is illegal for any company to make automated calls to a consumer’s cellular telephone without his or her prior express consent.”
Lusskin has filed several other TCPA lawsuits against debt collectors throughout the country. He hopes that the success in this case will encourage reform in the industry.
