The blood clot completely blocked the 24-year-old woman’s lungs, and caused her to suffer four heart attacks before she passed. The 3TV report also highlighted a letter written to the U.S. Food & Drug Administration (FDA) by six members of the U.S. Congress concerned about the safety issues surrounding NuvaRing. They requested that the agency consider adding a “Black Box” warning to the NuvaRing label to better inform women that the device may pose a higher risk of blood clots, heart attacks, strokes and death compared to other hormonal birth control methods. Yet despite receiving more than 1,000 reports of NuvaRing blood clots, some of which proved fatal, the 3TV broadcast noted that the FDA has not acted to mandate more prominent safety warnings for the product.

NuvaRing is a monthly contraceptive device that is marketed by Merck & Co. as being more convenient, but just as effective and safe as oral birth control bills. However, a study commissioned by the FDA and published in 2011 found a 56% increased NuvaRing blood clot risk, including a higher danger of deep vein thrombosis and pulmonary embolism, compared to oral contraceptives. In the summer of 2012, research published in both The New England Journal of Medicine and the British Medical Journal indicated that NuvaRing side effects included a higher risk of dangerous blood clots, as well as heart attacks and strokes.

According to court documents, nearly 2,000 NuvaRing lawsuits have been filed in U.S. courts on behalf of women who allegedly suffered deep vein thrombosis, pulmonary embolism, heart attacks, and strokes due to the device. These include more than 1,760 cases that are pending in federal multidistrict litigation now underway in U.S. District Court, Eastern District of Missouri. Just over 215 additional NuvaRing lawsuits have been filed in New Jersey Bergen County Superior Court. Among other things, the complaints claim NuvaRing releases higher amounts of hormones than other hormonal contraceptives, thereby increasing a user’s risk for these types of cardiovascular injuries.

Court records indicate that Merck & Co. agreed earlier this year to pay $100 million to resolve the NuvaRing lawsuits that have been filed in these litigations. If finalized, the NuvaRing settlement will provide an average of $58,000 to each plaintiff. However, women who claim to have suffered the most severe injuries, as well as the families of women who allegedly died due to NuvaRing injuries, will receive higher payments.
