The Congress, hosted by the National Guardianship Network in affiliation with the International Guardianship Network, is committed to ensuring excellence in guardianship practices around the world. The two host groups of the Congress examine and explore the concept of guardianship and fiduciary decision making through the lenses of public policy and recent clinical advancements in understanding capacity. The Congress itself is a collaborative meeting place for experts from around the globe. The attendees discuss and explore shared concerns as well as process ideas about overarching policies and practices to address numerous issues which arise in the realm of guardianship. Some of the topics that will be explored during this year’s conference include:
1. “Beyond Substituted Judgment and Best Interest: Can Improved Statutory Standards Produce Better Decision-Making Practices?” The overall focus being to discuss possible policy and legal reforms needed to more closely align the decisions guardians make to the desires and values of the incapacitated person.
2. “Comparative Prospective on Adult Guardianship” A panel discussion with experts from Japan, Great Britain, South Korea and the United States to discuss the various paradigms of guardianship globally. There will also be a specific emphasis in this panel on the recent reform initiatives of the United Nations Convention on the Rights of Persons with Disabilities in shaping guardianship policy.
3. “Adult Guardianship Decision – Making Process: Psychomorphological and Legal Perspective” Exploring the impact of various phobias and disorders and conflicts which may arise between the incapacitated person and his/her guardian during the course of treatment.
The sampling of topics above and the very existence of this Congress are just further examples of the increasingly globalized world in which we exist today. With an evolving global community it is becoming more common for families to settle within various countries spread throughout the globe.
