Magazine Features Attorney Kyle Humphrey’s Presentation on Links Between Criminal Law and Family Law

Criminal Defense Attorney Kyle J. Humphrey recently informed family law attorneys from the Kern County Bar Association about criminal issues that could apply to their cases. The bar association’s magazine discussed the highlights of the presentation.

Res Ipsa Loquitur, a monthly magazine published by the Kern County Bar Association, has featured an article that summarized a presentation that Bakersfield Criminal Defense Attorney Kyle J. Humphrey presented to the bar association’s Family Law section. The article, titled “Criminal law for family lawyers” was featured on page 28 of the May 2014 issue of Res Ipsa Loquitur. According to the magazine article, Attorney Humphrey’s March 26, 2014 presentation provided insight on criminal law issues that may impact the clients of family law attorneys. As is explained in the magazine article, Attorney Humphrey drew from his own experience to discuss a number of criminal law concepts that family lawyers should know about. He emphasized the following: the importance for domestic violence or child abuse suspects to explicitly invoke their Fifth Amendment right to remain silent and consult with a lawyer; the importance for family members to be on the same page concerning consent for police searches or residences; and the possible lifetime loss of gun ownership rights in domestic violence restraining order cases.

Attorney Humphrey also discussed a number of other relevant criminal law issues. These included a domestic violence victim’s right not to cooperate with officers, the importance for spouses to change their electronic devices’ passwords when they are dealing with marital issues, and the use of spouse phone calls for obtaining incriminating statements from individuals accused of domestic violence or child abuse.

Attorney Humphrey has a broad scope of experience in criminal law. After earning his law degree from Western University School of Law, he launched his legal career by becoming a criminal prosecutor. He worked as a prosecutor for the Kern County District Attorney’s office for seven years before becoming a private-practice criminal defense lawyer. He has now been working as a criminal defender for more than 20 years. As a defense attorney, Mr. Humphrey has taken at least 100 cases to jury verdict, and he has resolved many other cases through other forms of disposition. The lawyer is a former President of the Defense Section of the Kern County Bar Association, and he is currently a member of a number of other professional organizations.
