The San Diego Employment Law Lawyers File A Class Action Lawsuit Against Red Delivery Guy for Alleged Misclassification of Delivery Drivers as Independent Contractors
Riverside, California (PRWEB) June 23, 2014 -- On April 11, 2014, the San Diego employment law attorneys at Blumenthal Nordrehaug & Bhowmik filed a class action lawsuit against Red Delivery Guy, Inc. alleging that the company classified their delivery drivers as independent contractors in order to avoid paying Red Delivery Guy's share of payroll taxes, overtime wages, and other business expenses. The case entitled Ramirez, et al. v. Red Delivery Guy, Inc. is currently pending in the Riverside County Superior Court, Case No. RIC 1403567.
According to the class action complaint, Red Delivery Guy allegedly devised an illegal scheme of classifying the delivery drivers as independent contractors even though the company allegedly exercised a high degree of control over the delivery drivers when they performed their work. Specifically, the lawsuit alleges that Red Delivery guy "provides the customers and RDG provides the instructions as to how to deliver the food and tells the driver what homes to deliver to." Among other things, the Complaint also alleges that the drivers were required to wear a uniform provided by Red Delivery Guy.
