According to the class action complaint, Red Delivery Guy allegedly devised an illegal scheme of classifying the delivery drivers as independent contractors even though the company allegedly exercised a high degree of control over the delivery drivers when they performed their work. Specifically, the lawsuit alleges that Red Delivery guy "provides the customers and RDG provides the instructions as to how to deliver the food and tells the driver what homes to deliver to." Among other things, the Complaint also alleges that the drivers were required to wear a uniform provided by Red Delivery Guy.
