Long Term Disability Firm A. Waxman and Associates Discuss Workplace Issues and Long Term Disability Benefits
Toronto, ON (PRWEB) July 17, 2014 -- Some employers offer group insurance policies which provide employees access to long term disability benefits. Under a long term disability policy, a person can make a claim for long term disability benefits for a number of conditions, which could render him or her unable to work. Claims can be made for either physical or psychological illnesses, or a combination of both.
Psychological illnesses can include claims for including depression, anxiety and post traumatic stress disorder. Long term disability claims can also involve claims related to conditions arising from stress. Stress, including workplace stress, can lead to serious conditions including what is known as burnout. Burnout can cause both physical and psychological difficulties perform the essential duties of his or her job. A person may also experience work related stress as a result of conflict. Examples of conflicts can include harassment or abuse, either verbal or physical and discrimination. Workplace conflicts/stress can cause similar symptoms as burnout.
Claims related to workplace stress may be denied on the basis that as the work environment is the trigger for symptoms, a change of environments will help symptoms to resolve. Because claims relating to workplace stress involve depression, anxiety and components of mental illness, the solution is not that simple. An employee may require long-term treatment and may be unable to work for a long period of time, regardless of whether it is his or her own occupation or any occupation.
An employee who makes a claim for burnout may also encounter difficulties with entitlement to benefits on the basis that his or her symptoms are not severe enough or because insurance companies may not recognize burnout as an actual medication condition. This does not mean a person is unable to apply for benefits or should hesitate to apply.
It is important to seek advice from a qualified, experienced lawyer who can explain the legal process. Once you have received notice that your claim has been denied, your claim is subject to a limitation period and you have a certain amount of time to sue your insurance company.
If you have applied for long-term disability benefits and your application was denied at the outset, or your benefits have been terminated, consult an experienced long-term disability lawyer as soon as possible.
