The firm hereby alerts the public that a Benicar HCT lawsuit that was filed in California has been removed to federal court by the defendant. The plaintiff claims that she contracted chronic diarrhea as a result of using this medication.
Specifically, this Benicar HCT lawsuit was filed in the Superior Court of California, County of San Diego and it was filed on June 17, 2014. The case is entitled, Ambler, et al v. Daiichi Sankyo, Inc. It was assigned a case number of 37-2014-00012743-CU-PL-CTL. Three days after the lawsuit was filed in San Diego, the defendant filed a motion in the United States District Court, Southern District of California to remove the case to federal court. That matter was assigned a case number of 14CV1475WQHBLM. The reason that this motion was filed was because the defendant argues that there is diversity in jurisdiction necessary for doing so.
According to the court documents filed with the original lawsuit in state court, the plaintiffs, a husband and wife, allege that she began using Benicar HCT in 2010 to help treat the symptoms associated with high blood pressure. The court documents further allege that as a result of using this medication that the female plaintiff suffered from conditions that include sprue-like enteropathy, lymphocytic colitis, microscopic colitis, chronic diarrhea, weight loss, nausea, vomiting, malnutrition and dehydration. The court documents also allege that neither the female plaintiff nor her doctor were aware of the potential risks involved with using this medication.
The court documents filed in the state court action further state that the male plaintiff is seeking damages for loss of companionship with his wife. The documents state that the female plaintiff was forced to remain under hospital care for long periods of time and that she suffered several different forms of economic and non-economic damages. The state court action also seeks the recovery of punitive damages based on the allegation that the defendant knew of the risks of using this product and that it did not warn the public in a timely manner.
The Benicar HCT lawyers at Parilman & Associates urge anyone who may be using this medication to be wary of any strange or unexplainable symptoms that may arise. The firm further urges anyone who experiences these symptoms to seek immediate medical attention so that they can avoid any potential problems associated with this medication.
