(PRWEB) August 05, 2014 -- Ms. Crowder, a 74-year-old retired day care employee, testified that she was walking in front of the Defendants’ place of business when she tripped and fell on a board that had been part of a police barricade and was left on the Defendants’ sidewalk.
Pursuant to the terms of the settlement agreement, the specific location of the incident and the identities of the Defendants shall remain confidential.
As a result of the trip and fall accident, Ms. Crowder testified that she suffered a spiral fracture in her right ankle and a fracture of her fifth metatarsal in her left foot. Ms. Crowder was required to undergo surgery to repair both injuries. She further testified, that despite the surgical intervention, she continues to have pain in both of her lower extremities and is forced to walk with a cane, both of which limit her mobility.
The Defendants alleged that plaintiff was prone to falls and was negligent for not watching where she was walking. They further asserted that the board involved in the accident was not theirs and they had not placed it on the sidewalk.
The confidential settlement was reached between Plaintiff and the Defendants in the amount of $450,000.
