According to the arbitration award, arbitrated per the 321 statute, Bobby Udall' client, the plaintiff, was involved in an accident in March 2013 and incurred medical expenses of almost $8,500 due to the accident. His orthopedic surgeon recommended a lumbar decompression surgery to fix damage from the accident, which the insurance company found not necessary. The insurance company also refused to cover certain chiropractic services and an MRI performed in relation to the accident’s injuries.
The arbitration award also states that the insurance company proceeded to only offer the client $8,000. Bobby Udall stepped in and told the insurance company the client would not take the $8,000 and filed a law suit. The client completed an Independent Medical Exam (IME) with the defense’s doctor. The doctor reported that the lumbar surgery was not warranted, and a biomechanical expert completed a report saying the collision had been too minor to cause serious injuries.
During arbitration, Bobby Udall argued against the defense experts’ reports and proved that they were inconsistent with evidence from the accident. According to the arbitration, the arbitrator agreed that the plaintiff's injuries were caused and aggravated by the accident, warranting reimbursement and future costs for medical expenses. The arbitrator agreed to a $50,000 reward for the plaintiff from the defendant's insurance company.
