Houston, Texas (PRWEB) August 15, 2014
The attorney's fee will remain frozen at 25% and will not escalate if a personal injury or wrongful death case results in litigation or trial. If there are any medical liens or case costs they are deducted from the client's portion of any recovery. If there is no recovery there will be no fee to the client.
There have been many changes to the Texas laws (known as "tort reform") in the past twenty years by both the Texas Supreme Court and the Texas Legislature in cases involving matters such as motor vehicle accidents, premises liability and industrial accidents. A 25% fee on a personal injury or wrongful death case will enable the client to receive a greater portion of any recovery.
Many Texas attorneys have client fee agreements in personal injury and wrongful death claims that call for a fee of 40% or greater of any total recovery. This could result in the attorney receiving a bigger cut of any total recovery than the client.
