Orange County Personal Injury Attorney Obtains Large Settlement for Clients

Burns recently obtained a settlement of $100,000 for his client Irma Aguilar and $65,000 for her passenger Abel Avalos, for a total settlement of $165,000, after they were injured in a head-to-head car crash in Riverside County, California. The California Highway Patrol Traffic Collision Report (#2014-01-0006) indicates that the other driver was Mr. Grant Joseph Say.
According to the CHP report (#2014-01-0006), Ms. Aguilar was driving westbound on Domenigioni Parkway in Riverside County, CA at approximately 3:00 PM towards the intersection of Domenigioni Parkway and California State Route 79. Mr. Grant Joseph Say was driving in the opposite direction on Domenigioni Parkway. The CHP report goes on to state that Mr. Say made a left turn against a red do-not-turn arrow directly in front of Ms. Aguilar, causing a head-to-head accident.
The report concludes that damage to Ms. Aguilar’s car was major and that Mr. Say’s car also sustained major front-end damage. The CHP report found Mr. Say 100% at fault for the collision.
According to hospital records, Ms. Aguilar suffered major injuries, including a fractured ankle and fractured wrist. As a result, orthopedic surgery was required to repair her right ankle, involving the implantation of screws and pins, causing her major pain and discomfort during her recovery.
The passenger in Ms. Aguilar’s vehicle, Mr. Abel Avalos, also suffered injuries during the accident. According to hospital records, Mr. Avalos was diagnosed with deep lacerations of the right hand as well as a fractured finger. As a result, Mr. Avalos was unable to work while his finger was healing, according to his employment records.
Case documents show that Attorney John P. Burns and his staff sent a written demand for settlement to Mr. Say’s insurance company for the injuries sustained by Ms. Aguilar and Mr. Avalos. As a result, Mr. Say’s insurance company agreed to pay for Ms. Aguilar’s medical bills and pain and suffering for a total settlement of $100,000. Additionally, Mr. Say’s insurance company agreed to pay for Mr. Abel’s medical bills, pain and suffering, and lost wages for $65,000.
