Crosley Law Firm Reaches Settlement for Hand Amputation Victims at Commercial Bakery
San Antonio, TX (PRWEB) August 20, 2014 -- Crosley Law Firm, PC has reached a confidential settlement in two different cases involving hand amputation against Lone Star Bakery for an undisclosed amount. The two claimants, Pete Gonzales and Erik Salgado, were injured in March and May of 2011, respectively. The injuries were caused by two different machines at Lone Star Bakery, and resulted in severe injury to the left hand of each man.
At the time of both of these accidents, Lone Star Bakery was short-staffed, having lost 200 of its
500 workers in connection with a U.S. Immigration and Customs Enforcement inspection (San Antonio Express-News, February 23, 2011, MySanAntonio.com).
In addition to the added pressure to maintain production levels for these men, the plaintiffs alleged that Lone Star Bakery failed to implement and adhere to basic safety measures that would have prevented these accidents, as supported by the U.S. Department of Labor's Occupational Safety and Health Administration's issuance of 49 workplace violations (US Department of Labor, April 20, 2011, OSHA.gov). Russ Rasnic, PE, director of forensic engineering for Ryan Engineering, Inc., testified that these injuries could have been avoided if certain safety measures were put into place before proceeding with production.
Lone Star Bakery is a non-subscriber under state workers' compensation laws, and the claims were handled in binding arbitration before the American Arbitration Association.
As a result of the evidence presented in this case, Crosley Law Firm was able to reach a settlement for these two men that compensated them for the costs of injuries, future medical care, mental and physical anguish, and loss of income, both now and in the future.
