The injunction follows a verdict earlier this year handed down by the United States District Court for the Central District of California, Western Division (Case No. 09-CV-6988) in which a jury found that Ventura, California-based Neurovision Medical Products, Inc. is the rightful owner of the NEUROVISION trademark and that NuVasive had been willfully infringing upon Neurovision Medical’s trademark rights. The jury also found clear and convincing evidence in Neurovision Medical's favor that NuVasive had defrauded the United States Patent and Trademark Office by registering the NEUROVISION mark for itself despite knowing of Neurovision Medical’s superior rights in the mark. The jury awarded $30 million.
Following the verdict, the judge ruled in favor of Neurovision Medical by denying NuVasive’s post-trial motions and granting an injunction against the Company. In the judge’s written decision granting the injunction, she found that Neurovision Medical “would suffer irreparable harm absent an injunction” and added that she “has no confidence that in the absence of an injunction, [NuVasive] will stop using the mark.”
