New DUI Law Makes Blood Tests Mandatory
Lake Worth, FL (PRWEB) September 15, 2014 -- Florida is now one of several states holding “no refusal” checkpoints. This means that anyone who refuses a breath test could be forced to undergo a mandatory blood test. Federal government data shows Florida has among the highest rate of breathalyzer refusal. The new law is aimed to lower this rate and save lives.
According to CBS Miami, the new Florida law requires people to take a breath, blood or urine test if they are arrested for a DUI. Florida’s “implied consent” law says that if a person is lawfully arrested by an officer who has probable cause to believe that they have been driving under the influence, then the person consents to taking a chemical test of their blood, breath or urine for the purpose of determining their blood alcohol content (BAC) or for drugs. A judge will be on site and ready to issue an order requiring a blood test.
Many believe this new law will make people think twice before drinking and driving and help to keep the roads safer. Others, however, believe that the new law violates basic civil rights.
