Wright & Schulte LLC Files C8 Lawsuit On Behalf Of A West Virginia Man Who Developed Ulcerative Colitis Purportedly From Drinking C8 Contaminated Water

The C8 negligence complaint states that the man was diagnosed with ulcerative colitis in July 2002 and he will need lifelong medical treatment. The plaintiff in the C8 lawsuit filed by Wright & Schulte LLC is among thousands of Ohio and West Virginia residents who were exposed to the chemical perfluorooctanoate acid, commonly known as C8. According to a report by the C8 Science Panel, DuPont’s Washington Works plant, located in Parkersburg, West Virginia, had been releasing large amounts of C8 chemicals into landfills along the Ohio River, private drinking water wells, and into the Ohio River. As a result of the C8 release from the plant, a class-action lawsuit was filed in 2001 on behalf of nearly 70,000 Ohio and West Virginia residents living in the water districts near the plant. In 2005, DuPont settled the class action lawsuit. As part of the settlement, the C8 Health Project was created to gather health information from the nearly 70,000 members of the class action who were exposed to C8 due to living near the Washington Works plant. The information-gathering began in July 2005 through written questionnaires and a series of blood tests, which included a test to determine the amount of C8 in the residents’ blood. The health data was shared with the C8 Science Panel, which was also created as a part of the class action lawsuit settlement. The C8 Science Panel was asked to determine whether there were probable links between C8 exposure and diseases in the community.

The Science Panel found six probable links with exposure to C8: Ulcerative Colitis, high cholesterol, thyroid disease, pregnancy-induced hypertension (pre-eclampsia), kidney cancer and testicular cancer. Individuals who drank contaminated water for at least one year prior to December 4, 2004 from six water districts or from private wells within those districts were eligible to file personal injury lawsuits. The six affected water districts are:

• Little Hocking, Ohio,
• Lubeck Public Service District, West Virginia
• Mason County Public Service District, West Virginia,
• Tuppers Plains, Ohio
• Village of Pomeroy, Ohio
