Judge Overseeing Federal Testosterone Lawsuits Issues New Case Management Order, The Oliver Law Group Reports
Detroit IL (PRWEB) October 11, 2014 -- The federal judge overseeing some 200 testosterone lawsuits pending in the U.S. District Court, Northern District of Illinois, has issued a new Case Management Order, The Oliver Law Group reports. According to court documents, the August 25th Order sets the stage for discovery to move forward in the federal multidistrict litigation, which involves product liability testosterone lawsuits that allege the use of AndroGel and similar low testosterone therapy drugs caused some men to experience heart attacks, strokes and other life-threatening heart problems.

Among other things, the new Case Management Order directs the parties to submit initial disclosures about potential witnesses and documents in testosterone therapy lawsuits by mid-October. Attorneys involved in the testosterone lawsuit litigation were also ordered to continue with negotiations regarding the content of Plaintiffs’ Fact Sheets, and to take steps to coordinate the federal proceeding with state litigations involving similar testosterone lawsuits.
Court records indicate that testosterone treatment lawsuit filings have been growing since January, when the U.S. Food & Drug Administration (FDA) first announced that it was investigating a possible increased risk of heart attack, stroke and death among men who receive testosterone treatment. In addition to claiming that the medications are associated with serious cardiovascular side effects, the cases pending in the Northern District of Illinois also question the way the drugs were promoted, and contend that inappropriate marketing of testosterone medications caused many men undergo treatment in the absence of any real medical need.

As part of its review, the FDA convened an advisory panel meeting on September 17, 2014, at which time a group of medical experts were asked to make recommendations to mitigate the possible heart risks associated with low testosterone therapy. According to a report from The New York Times, the advisors voted 20-to-1 to recommend that the medications’ labels be modified to ensure they are not prescribed to men who merely suffer from low libido, fatigue or other problems related to aging. In another 20-to-1 vote, the advisors recommended that the manufacturers of testosterone replacement therapies be required to conduct research investigating the potential heart risks associated with their use. While the FDA does not have to adopt the recommendations of its advisory panels, it generally opts to do so in most cases.
