Agrisure Viptera, (also known as MIR 162) is a GMO corn seed product developed by Syngenta AG that enables plants to produce proteins that ward off pests, according to the Wall Street Journal. While Syngenta sought China’s approval to sell the GMO seed in 2010, it has yet to be cleared for sale in that country. By April 2014, China’s decision to reject corn shipments that contain Agrisure Viptera had cost U.S. grain companies an estimated $427 million. The Syngenta GMO seed controversy has also negatively affected the price of corn and soybeans, costing U.S. farmers millions.

On September 12, 2014, Cargill, Inc. and Trans Coastal Supply Co. each filed Syngenta lawsuits over the company’s handling of Agrisure Viptura. According to the Trans Coastal lawsuit, which is currently pending in U.S. District Court, Central District of Illinois, Syngenta’s actions could ultimately cost it as much as $141 million. “Syngenta’s motivation in prematurely releasing Viptera corn is greed,” Trans Coastal’s lawsuit says. “If not stopped, Syngenta is going to continue to destroy U.S. exports of corn and DDGs to China.”

In a complaint filed in the Louisiana’s 40th Judicial District Court, Cargill alleges that it has been exposed to more than $90 million in losses. “Given the prevalence of crops grown from the Viptera seed in the U.S. corn supply, the Cargill Plaintiffs can no longer sell U.S.-grown corn to China,” the lawsuit charges.
