The presentation will focus on significant e-Discovery issues faced by legal professionals today and how they are viewed from the bench. Topics will include:
• Proportionality: How are the new amendments to the FRCP going to effect change?
• Facebook/Social Media: What do judges look for to link Facebook/social media evidence to an owner?
• Predictive Coding: Can this be useful technology or is it currently too complicated?
• Transparency and Defense of Process: Who has the burden of proving that they were delinquent in producing discovery?
“We have an exciting panel lined up for the Masters Conference in DC,” said Dan Regard. "I am honored to be moderating a session with these three esteemed judges. It is a tremendous opportunity to see the ever-changing landscape of e-Discovery and the bench through their eyes.
