The complaint alleges that Silicon Valley does not have a policy or practice which provides meal and rest breaks to their employees thereby resulting in a failure to provide all legally required off-duty meal and rest breaks to their security guard employees who were paid on an hourly basis in California. The complaint further alleges that Silicon Valley failed to compensate the Plaintiff and other security guards for missed meal and rest breaks. The California Labor Code, and specifically California Labor Code Sections 226.7 and 512, state that employees who are classified as non-exempt and paid on an hourly basis are legally entitled to take 30 minute uninterrupted meal breaks, meaning no work is required to be performed during the required off-duty meal period.
