Xarelto Lawsuit News Update: Location of the Xarelto MDL to be determined soon by the Judicial Panel on Multi-District Litigation

The Pradaxa MDL is a consolidation of thousands of Pradaxa bleeding lawsuits. In his role as Pradaxa Liaison counsel, Mark Niemeyer was instrumental in running and ultimately resolving the Pradaxa lawsuits. Pradaxa is a blood thinner very similar to Xarelto. Both Xarelto and Pradaxa were developed to replace Coumadin, a blood thinner that has been around since the 1950s. Blood thinners are used for those individuals that have suffered clotting events in the past to thin the blood and decrease the risk of future clotting events.
The Institute for Safe Medication Practices, in its May 7, 2014 Quarter Watch report, noted an increase in reporting to the FDA of serious adverse events in individuals taking Xarelto. The adverse events were bleeding events such as gastrointestinal bleeds and hemorrhagic strokes. The ISMP’s report detailed that by the end of 2013, the volume of adverse events involving Xarelto were steadily increasing and outnumbered Pradaxa bleeding events. This concern led to the attorneys at NGK Law investigating whether or not there were grounds for a Xarelto lawsuit.
NGK Law has already filed a Xarelto lawsuit in the U.S. District Court for the Southern District of Illinois, Williams v. Janssen Research & Development, LLC et. al, Cause no. 3:14 cv-01278. In NGK Law’s Xarelto lawsuit, it is alleged that one of the primary concerns about Xarelto is that while individuals are taking Xarelto, they do not need to have their blood levels routinely monitored. It is further alleged that while individuals are taking Coumadin, individuals must submit to monthly blood tests to make sure they are receiving the right dose of Coumadin. The lawsuit claims that the makers of Xarelto sold the drug on the idea that individuals do not need to submit to monthly blood tests, and therefore Xarelto is more convenient. In filing the Xarelto lawsuits, the attorneys at NGK Law have made claims that individuals on Xarelto do, in fact, need to regularly monitor their blood levels. NGK Law’s Xarelto attorneys argue that the lack of monitoring leads to an increase in the risk of bleeding events.
It is expected that the majority of Xarelto lawsuits around the United States will be consolidated into a Xarelto MDL. A hearing is being held in the In re: Xarelto Products Liability Litigation, MDL No. 2592, in which the JPML will determine where the MDL for Xarelto lawsuits will be located. There has been a request that the litigation be sent to the U.S. District Court for the Southern District of Illinois.
