Lawrence A. LeBrocq, partner in the firm of Garces, Grabler and LeBrocq, recently reached a $1.2 million Verdict at trial for docket number MID-L-8484-11, a slip-and-fall case against Bogi Apartments, LLC.

Tried before a jury at Middlesex County Superior Court, the case involved a resident of a New Brunswick apartment complex owned by Bogi Apartments who slipped and fell due to improper snow and ice removal from the doorstep and stairs. After the accident, which caused temporary loss of consciousness, the resident was taken by ambulance to the emergency room at Robert Wood Johnson and treated for neck and lower back injuries. For over four years, the resident endured multiple pain management procedures and minimally invasive surgery to the lower back, which failed to completely alleviate the suffering, forcing the resident to stop working.

At trial, attorney LeBrocq brought in the resident’s neighbors as witnesses to testify against Bogi Apartments and their constant neglect of the property. There were over 11 inches of snow the prior evening, which ended at approximately 7:00 a.m. on the Sunday of the fall. Mr. LeBrocq successfully argued the defendant had a duty to maintain the safety of all entrances and exits; they were aware of the dangerous condition and had sufficient time to clean the apartment complex. The fall occurred at approximately 1:00 p.m., and Mr. LeBrocq claimed Bogi Apartments failed to remove the snow and ice within a reasonable amount of time. The jury unanimously found Bogi Apartments 100 percent liable for the accident and awarded the plaintiff $1.2 million for pain, suffering and lost earnings.
