The lawsuit claims that the Freebirds' Managers spent almost all of their workday working the cash register, greeting customers, taking customer orders, conducting prep work, washing dishes, cooking food, and taking inventory, which the complaint asserts are all non-exempt job tasks. The Complaint also alleges that the Managers were working over eight hours in a workday and/or over forty hours in a workweek, but because Freebirds classified the Managers as exempt employees they were not allegedly paid the correct overtime pay. As a result, the lawsuit seeks an unspecified amount of back overtime pay for current and former Managers working for Freebirds World Burrito in California.
