On December 17, 2014, the San Francisco employment law lawyers at Blumenthal Nordrehaug & Bhowmik filed a class action lawsuit seeking overtime wages against Tavistock Freebirds, LLC alleging the fast food burrito chain misclassified their Managers and as a result allegedly failed to pay their Managers overtime pay and missed meal break penalties. The Tavistock Freebirds, LLC class action Complaint, Case No. 37-2014-0173010 is currently pending in the Sacramento County Superior Court for the State of California. The lawsuit claims that the Freebirds' Managers spent almost all of their workday working the cash register, greeting customers, taking customer orders, conducting prep work, washing dishes, cooking food, and taking inventory, which the complaint asserts are all non-exempt job tasks. The Complaint also alleges that the Managers were working over eight hours in a workday and/or over forty hours in a workweek, but because Freebirds classified the Managers as exempt employees they were not allegedly paid the correct overtime pay. As a result, the lawsuit seeks an unspecified amount of back overtime pay for current and former Managers working for Freebirds World Burrito in California.
