According to the multidistrict litigation docket of the U.S. Judicial Panel on Multidistrict Litigation (JPML). In June, the JPML granted a request to consolidate all federally filed testosterone lawsuits for pretrial proceedings. In granting the request, the judicial panel transferred all testosterone lawsuits, regardless of the testosterone manufacturer named as the defendant, to the U.S. District Court, Northern District of Illinois and assigned Judge Matthew F. Kennelly to manage the litigation. The JPML's industrywide consolidation includes testosterone lawsuits filed against:
• AbbVie Inc. and Abbot Laboratories, which manufactures and markets AndroGel
• Actavis, Inc. and Watson Pharmaceuticals, manufacturers of AndroDerm
• Auxilium Pharmaceuticals, Inc., manufacturer of Testim

• Eli Lilly and Company and Lilly USA LLC, the makers of Axiron
• Pfizer Inc. and its subsidiary, Pharmacia & Upjohn Co.,which makes and markets Depo-Testosterone.

The request to consolidation of low testosterone therapy lawsuits and the spike in testosterone filings came after the U.S. Food and Drug Administration (FDA) announced in January 2014 that it was launching an investigation into the effectiveness and safety of all FDA-approved testosterone products that treat hypogonadism, which is a low level of testosterone in men due to an underlying medical condition. The FDA said it was examining the products after reviewing two observational studies that showed cardiovascular risks associated with testosterone use in older men. The first study, published in the November 2013 Journal of the American Medical Association, found that older men who had underlying cardiovascular disease and took low testosterone treatment had a 30 percent increased risk of having a stroke, heart attack or death compared to men who did not take the low testosterone medication. The second study, published in the PLOS One Journal on January 29, 2014, showed that men over 65 and younger men with a pre-existing heart disease were at a greater risk of having a heart attack within the first 90 days after taking low testosterone drugs for the first time.
