Transvaginal Mesh Lawsuit News: New Order Governs Discovery For Third Wave of Bellwether Cases In Federal C.R. Bard Litigation

Bard, Inc. continue to move forward in the federal multidistrict litigation now underway in U.S. District Court, Southern District of West Virginia, where Bernstein Liebhard LLP partner, Jeffrey S. Grand, is currently serving on the Plaintiffs’ Steering Committee. According to a Pretrial Order issued on March 12, 2014, the Court has established new deadlines pertaining to Expert Discovery and Motions Practice for the Avaulta mesh claims selected for the proceeding’s third wave of bellwether trials. Among other things, the Order directs plaintiffs to serve expert disclosure and reports no later than March 19, 2015. C.R. Transvaginal Mesh Litigation
Court documents indicate that more than 10,500 transvaginal mesh lawsuits have been filed against C.R. Bard in the Southern District of West Virginia. All of the lawsuits pending in the litigation were filed on behalf of women who allegedly experienced mesh erosion, chronic pain, organ damage and other serious vaginal mesh complications following implantation of the company’s pelvic mesh devices.
According to court records, C.R. Bard has also been named a defendant in more than 1,700 additional vaginal mesh claims that are currently pending in a multicounty litigation now underway in New Jersey’s Bergen County Superior Court. Court documents indicate that more than 70,000 claims have been filed in the various transvaginal mesh litigations underway in West Virginia.
Mr. Grand is also serving as Co-Liaison Counsel in a second multicounty county litigation established in New Jersey’s Bergen County Superior Court for vaginal mesh lawsuits filed against Ethicon, Inc. In addition, Mr. Grand was member of the Plaintiff’s trial team for that proceeding’s first jury trial, which ended in March 2013 with an $11 million verdict for a woman who was injured by Ethicon’s Gynecare Prolift device.
