Woman falls in store due to negligently placed racks, Layfield & Wallace settle the case for $237,500

Philip Layfield and Mani Navab of Layfield & Wallace, APC settled a slip and fall case against a chain of discount stores, National Stores, Inc., for $237,500.00 on January 15, 2015. This case was originally filed in Pomona, California on February 20, 2013, but on April 22, 2013 was transferred to the Stanley Mosk Courthouse in Los Angeles County. The case name was Maria Cardenas v. National Stores, Inc., case number KC065675.

According to court documents, on September 28th, 2012, Maria Cardenas was exiting a store named Fallas Discount Store, when she tripped and fell. Fallas Discount Store allegedly negligently placed numerous clothing racks with protruding legs in close proximity of one other. These clothing racks stood outside of the store blocking the entrance and exit of the store. The plaintiff brought a premises liability suit based on the fact that she believed the store was negligent in its placement of the clothing racks, as well as the fact clothing had falled from the rack, covering the protruding legs over the rack and making them less noticable. Ms. Cardenas’ foot caught one of the concealed protruding legs, causing her to trip and fall on the concrete sidewalk. She landed on her head and wrist. She was taken to the hospital by ambulance, and suffered a fractured left wrist of distal radial and ulnar, forearm fracture, and lower back and neck pain. Ms. Cardenas, a seamstress and sole income earner for her family, lost valuable income as the accident greatly impacted her health and caused her to lose work.
