The Complaint alleges that the Senior Systems Administrators employed by Kaiser Foundation Hospitals, Inc. in California were improperly classified as exempt from receiving overtime pay and related benefits, such as meal and rest breaks.

On March 12, 2015, the San Diego labor lawyers at Blumenthal, Nordrehaug & Bhowmik filed a Complaint against Kaiser Foundation Hospitals, Inc. on behalf of the company's Senior Systems Administrators. The class action lawsuit claims that Kaiser Foundation Hospitals, Inc. misclassified their Senior Systems Administrators in order to avoid paying these employees overtime pay. The class action lawsuit, Case No. 37-2015-00008539-CU-OE-CTL, is currently pending in the San Diego County Superior Court for the State of California. The Complaint alleges that the Senior Systems Administrators employed by Kaiser Foundation Hospitals, Inc. in California were improperly classified as exempt from receiving overtime pay and related benefits, such as meal and rest breaks.

The class action lawsuit claims that the Senior Systems Administrators spent most of their day engaged in a finite set of non-managerial, non-exempt tasks throughout their shifts in order to provide support for Kaiser Foundation Hospital's Call Center computer systems by troubleshooting and repairing computer systems. The Complaint alleges that the Senior Systems Administrators repaired and replaced personal computers and servers, installed software and operating systems, processed new users on computer systems, reset user passwords for mainframe and windows domain logins, modified Access database applications for the call center, and tracked requests for services by other support entities and business partners. Additionally, the Complaint alleges that the Senior Systems Administrators did not supervise other employees working for Kaiser Foundation Hospitals, Inc.
