New Jersey Appellate Division Affirms the $2,300,035 Jury Verdict Obtained by Jeffrey M. Rich, Esq in Dental Nerve Injury Case

Rich, Esq. of Rich & Rich, P.C. recently announced that the $2,300,035 verdict he won on behalf of his client was upheld on appeal. Attorney Rich represented Lauren Sheets in Sheets v. Siegler (A-1836-11T4), which concluded with the favorable verdict in 2011. The court documents state that the dental nerve injury case involved a transected lingual nerve that occurred during a negligently performed lower wisdom tooth extraction on Ms. Sheets, then 25 years old. The verdict is believed to be the highest of its kind in the nation.
According to court documents, on April 13, 2007, the previously asymptomatic young woman was put to sleep by the use of anesthetic as prep for oral surgery. When Ms. Sheets awoke, she experienced, as she described, “excruciating pain.” Howard R. Siegler D.D.S. proceeded to prescribe Ms. Sheets narcotic pain medication. When explaining her symptoms three days later during a post-surgery visit, Dr. Siegler stated that “sometimes these things can resolve themselves.”
The court documents explain that, in the four years following the tooth extraction, Ms. Sheets was treated by several other dental physicians. She received surgery to repair and reconnect the lingual nerve as well as steroid injections to treat a painful neuroma that had grown in her mouth. Her pain continued, and finally in 2011 she was told that remission of the neuroma is unlikely and she can expect to be on pain medication indefinitely.
Attorney Jeffrey M. Rich filed suit against Dr. Siegler that year on behalf of Ms. Sheets in New Jersey Superior Court, winning a judgment of more than $2 million. The defendant filed an appeal in 2013, and the New Jersey Superior Court Appellate Division made the decision to uphold the original verdict on March 27, 2015.
