The service is free, easy to use and completely automated. To set up a questionnaire, users visit esiquestionnaire.com, provide their name, the email address to which questionnaire responses should be sent and the name of the legal matter for which the questionnaire is being used. Once this information is entered, an email is sent to the selected ESI custodians with a link to the questionnaire. After the custodians respond, answers are delivered by secure email to the person setting up the questionnaire. Litigation hold notice language may also be included and sent to the ESI custodian respondents.
Questions in the questionnaire address:
–identification of computers and devices used by the ESI custodians;
–the custodian’s knowledge about the legal matter;
–the custodian’s practices regarding email usage, storage of work related documents and general document retention practices.
