New Electronic Recording for Timeshares, Intervals and Vacation Ownerships in Hawaii by Deed and Record

A deed is a document used to transfer ownership of real property. Deeds to change Hawaiian resort ownership have many names. These deeds are referred to as “Vacation Plan Conveyance Documents,” “Vacation Ownership Deeds,” “Interval Deeds,” “Interval Conveyance Deeds,” “Interval Ownership Deeds,” “Interval Warranty Assignments” and "Timeshare Deeds."
Deeds are used to fund trusts. Deeds are also used to add or remove a co-owner holding title as joint tenant. The most frequent use of deeds is to add a spouse as owner due to marriage, or to remove a spouse as owner due to divorce.
For example, ownership in a Hawaiian resort is awarded to one spouse in a divorce decree or marital settlement agreement. Hawaiian timeshares, intervals and vacation ownerships are often overlooked in funding of trusts. A trust is created to avoid probate. But if ownership is not changed to the trust probate is required. Hawaiian resorts owned by a trust avoid probate and avoid court supervision. A deed is used to make the trust the owner.
Another way to avoid probate is to add a relative as co-owner as a joint tenant. In joint tenancy the deceased owner’s interest disappears by operation of law. The surviving joint tenant becomes the sole owner and avoids probate.
