Philadelphia, PA (PRWEB) May 08, 2015 -- Ms. Barnes, a 42 year old woman, testified that she was injured while using an interior stairway at the property located at 6212 North Hope Street, Philadelphia, PA. The property is owned by defendant, PHL Rental Properties, LLC and was maintained by defendant, Johnny Dang. Ms. Barnes, testified that the interior stairway did not have an adequate hand railing and the surface of the steps was unsafe. The defendants asserted that the steps were safe and that Ms. Barnes’ fall was not caused by the condition of the steps.
Ms. Barnes testified that as a result of her fall, she suffered a displaced fracture to her left distal fibula and a tear to her right quadriceps tendon. Ms. Barnes testified that the right quadriceps tear required surgical repair. She testified that as a result of these injuries, she continues to walk with a limp and experiences ongoing pain and swelling in her right knee and left ankle. She testified that despite the surgical intervention, her right quadriceps muscle has atrophied, leading to reduced strength in her right knee, which has limited her ability to exercise.
Ms. Barnes also testified that she continues to have pain on the outside of her left foot and her injuries prevent her from wearing a variety of shoes, including high heels. Ms. Barnes will continue to have significant scaring on her right knee and will not return to her pre-fall condition.
After a three day trial and three days of jury deliberations, Ms. Barnes was awarded $450,000 for her injuries. The jury found that defendant, Johnny Dang was acting as the agent of defendant, PHL Rental Properties, LLC and that defendant PHL Rental Properties, LLC was 100% responsible for Ms. Barnes’ injuries.
