The Complaint claims that the company failed to allow their California employees to take their legally required 30 minute meal breaks prior to their fifth hour of work. According to the class action lawsuit filed against Adecco USA, Inc., the company allegedly failed to provide their non-exempt employees paid on an hourly basis with thirty minute meal periods before the employees worked five hours. The penalty for failing to provide adequate and timely meal breaks is one hour of the employee's regular rate of pay under the California Labor Code.
