PreCheck, Inc., a background screening and credentialing firm specializing in the healthcare industry, recently joined Brian Sharp, Chief Marketing Officer at HRsoft, on Thursday, July 9, 2015 for the talent management software firm’s Talent Takeaways podcast. Vu Do, Vice President of Compliance at PreCheck, discussed background screening best practices and the latest compliance issues affecting employers.
“The Talent Takeaways podcast includes interviews from today’s top talent management experts to share ideas, strategies, resources and best practices that drive better HR results,” says Sharp.
In this episode, Do emphasizes the importance of establishing and consistently executing a clear adverse action policy to comply with the federal Fair Credit Reporting Act (FCRA).
“If employers are using background checks, it’s critical that they understand their legal obligations under the FCRA, and some of these are very specific and technical in nature,” says Do. “Employers just can’t ignore those duties and look solely to their screening provider as the ‘experts’ because specific duties are assigned to the employer. So if there are violations, it’s the employers that are getting sued, and pleading ignorance is no form of protection. A good provider will help their client understand their obligations.”
Do’s 30-minute podcast interview on Talent Takeaways offers employers great insight into the complexities of the FCRA. HRsoft’s podcast series also covers topics such as human resources management, HR technology, recruiting, compensation, employee engagement, and employee retention.
