Morgan will address the topic of “Developing a Defensible Electronically Stored Information (ESI) Preservation Program” alongside Anthony S. Lowe of Freddie Mac, Rosevelie Marquez Morales of Harris Beach PLLC, and Joe Banks of Microsoft Corporation. The panel will be moderated by Abel Cruz of Microsoft Corporation.
The panel will discuss the recent changes to the Federal Rules of Civil Procedure (FRCP) 37(e), and the consequences for improperly preserving ESI. Panelists will speak from an in-house counsel’s point of view, discussing the implications of the changes to the FRCP. In addition, several industry best practices will be shared related to how technology can help organizations prepare a defensible ESI preservation program (e.g. eDiscovery, legal holds, data preservation and deletion, securing and handling electronic evidence from discovery through its admission at trial, etc.).
