Terence P. McCourt, managing shareholder of the Boston office of Greenberg Traurig, LLP and chairman of the office’s Labor & Employment Practice, was a featured speaker for the Massachusetts Bar Association (MBA) Continuing Legal Education program “Independent Contractor v. Employee.” This seminar and live webcast took place at the MBA offices, from 2 p.m. – 5 p.m., Wednesday, Oct. 21, 2015.

McCourt and fellow panelists discussed a range of common independent contractor issues, and offered practical and strategic tactics for dealing with the Department of Labor (DOL), Attorney General's Office, and private litigants. Specific topics included:

  • Overview of Massachusetts Wage and Hour Law as it affects independent contractors
  • Latest court decisions interpreting Massachusetts General Laws, Chapter 149 Section 148B—the statute that presents the highest legal hurdle for businesses using independent contractors
  • Involvement of the DOL and the Attorney General in independent contractor matters
  • "Ask the Experts" Q&A session

McCourt represents a broad range of organizations in all facets of management-side labor and employment law. He has more than two decades of practice and has gained a national reputation for his practical, solution-oriented approach to employment law issues. With wide-ranging litigation experience, McCourt handles diverse employment matters, including employment discrimination and wrongful termination cases in state and federal courts, wage and hour compliance, labor arbitration cases, non-competition cases, internal corporate investigations, and NLRB proceedings. He also counsels employers concerning day-to-day human resources issues as well as a myriad of legal requirements in the workplace, particularly related to significant operational changes such as mergers, acquisitions, business relocations, or reductions in force. Previously, he was Deputy Chief Legal Counsel to the Governor of Massachusetts and General Counsel to the Massachusetts Secretary of Labor.
