Daniel Girard and Eric Gibbs have been representing plaintiffs nationwide in complex litigation concerning securities, personal injury, consumer protection, employment, and antitrust since 1995. Mr. Girard recently served as lead counsel In re Peregrine Financial Group Customer Litigation, Case No. 1:12-cv-5546 (N.D. Ill.), arising out of the failure of a commodities futures merchant. He is also court-appointed lead counsel in Corona v. Sony Pictures Entertainment, Inc., Case No. 2:14-cv-9600 (C.D. Cal.), and In re Herbal Supplements Marketing and Sales Practices Litigation, Case No. 1:15-cv-05070 (N.D. Ill.), concerning dietary supplements which were allegedly mislabeled. Earlier this year, Mr. Girard was appointed by the court to serve as interim co-lead counsel In re Lenovo Adware Litigation, Case No. 5:15-md-02624 (N.D. Cal.), concerning pre-installed VisualDiscovery spyware on personal computers that may violate federal privacy rights. Girard Gibbs is frequently recognized for its expertise in technology and privacy class action lawsuits and its demonstrated ability to work cooperatively with the large number of parties and attorneys involved in the consolidated litigation.
Serving as court-appointed lead counsel In re Adobe Systems, Inc. Privacy Litigation, 5:13-cv-5226 (N.D. Cal.), Mr. Gibbs recently secured a landmark ruling from the court that makes it easier for plaintiffs to seek relief following a breach. Currently, Mr. Gibbs serves on the Plaintiffs Steering Committee In re Anthem, Inc. Data Breach Litigation, Case No. 5:15-md-02617, litigating claims on behalf of 80 million Anthem subscribers whose personal information was breached in a hack in early 2015. Mr. Gibbs was one of four attorneys chosen to represent Anthem plaintiffs. Earlier this year, Mr. Gibbs was appointed by the court to serve as lead counsel In re Hyundai Sonata Engine Litigation, Case No. 5:15-cv-1685 (N.D. Cal.), concerning premature engine failure in the Sonata.
Both Mr. Girard and Mr. Gibbs are frequently invited to speak at law schools and litigation conferences nationwide.
Mr. Girard will appear as a panelist on January 28, 2016 at the American Bar Association and Duke Law Center for Judicial Studies Program on Case Management and Discovery Under the 2015 Civil Rules Amendments in San Francisco. On February 25, 2016, Mr. Girard will serve a panelist at the Institute for the Advancement of the American Legal System Civil Litigation Summit in Denver, Colorado.
On December 2, 2015, Mr. Gibbs will share “Lessons from Recent Automotive Industry Class Actions” at a Law Seminars International panel in New Orleans, Louisiana on Automobile Class Actions with Global Ramifications. Mr. Gibbs will return to New Orleans on March 10-11, 2015 to speak about “Ethical Considerations in Settling Class Actions” at Class Action Litigation in America – A National Symposium, presented by the American Bar Association Tort Trial and Insurance Practice Section. At the symposium, Mr. Gibbs will join other seasoned class action litigators, judges, and legal scholars to discuss class action management, recent class settlements, emerging trends and challenges in class litigation, arbitration, and more.
