Companies reach settlement agreement over use of Fire Cider trademark; Temple Turmeric agrees to cease the usage of the term 'Fire Cider'

Shire City Herbals, a Pittsfield, Mass.-based family-owned and operated organic tonic company, has reached a settlement agreement (Case No. 3:15-cv-30195-MGM filed with the U.S. District Court of the District of Massachusetts) with New York-based Temple Turmeric over the use of the term “Fire Cider”, a registered trademark owned by Shire City Herbals.

According to court documents, Temple Turmeric has agreed to cease the usage of the term ‘Pure Fire Cider’ in connection with their product and in all branding, marketing, advertising, and promotional instances (Case No. 3:15-cv-30195-MGM).

In time for the holiday season, the company will sell its Fire Cider tonic at the Union Square Holiday Market in New York City in the ‘Urban Provisions’ section of the market. The market operates every day through Dec. 24.
