Highlights of selected legislation covered in the newly updated protocol include:
• Changes to requirements for ozone depleting substances were issued in the form of amendments to the national "Ozone Protection and Synthetic Greenhouse Gas Management Act 1989" and the "Ozone Protection and Synthetic Greenhouse Gas Management Regulations 1995." These changes impact requirements for the manufacture and import of ozone depleting substances and requirements relating to refrigerants, extinguishing agents, and discharge of scheduled substances. Exemptions for certain types of equipment have been expanded and requirements of license holders and for recordkeeping have been revised.
• Changes to the "National Greenhouse and Energy Reporting Act 2007" and the "National Greenhouse and Energy Reporting Regulations 2008" have resulted in changes to the greenhouse gas registration and reporting requirements. In addition, the "Clean Energy Act 2011," which established a carbon pricing mechanism and trading scheme, was repealed effective July 1, 2014. The "Clean Energy Act 2011" had required liable entities to register and report annually on their emissions or potential emissions in relation to the 2012-13 and 2013-14 financial years under the "National Greenhouse and Energy Reporting Act 2007."
• On June 30, 2014, the "Environment Protection (Environment and Resource Efficiency Plans) Regulations 2007" were revoked, ending the Environment and Resource Efficiency Plans (EREP) program, which required Victoria’s largest energy and water users to identify and implement resource efficiency measures (energy, water and waste) with a payback of three years or less.
• As a result of amendments to the "Environment Protection Act 1970" in 2014, Victoria’s 13 waste management groups were consolidated into 7 regional waste and resource recovery groups. These groups have a legislative responsibility to each develop their Regional Waste Resource Recovery Plans to set out how the waste and resource recovery needs of their region will be met over a 10 year period.
• The "State Environment Protection Policy (Prevention and Management of Contamination of Land, June 2002)" was revised in September 2013 to reflect amendments to the "National Environment Protection Measure for the Assessment of Site Contamination."
• Effective July 1, 2014, the "Water Industry Regulations 2006" were revoked and the "Water (Trade Waste) Regulations 2014" took effect. The "Water (Trade Waste) Regulations 2014" replace the "Water Industry Regulations 2006" for the regulation of trade wastes.
• The "Code of Practice No. 27 – Dangerous Goods Storage and Handling" has been replaced by the "Code of Practice for the Storage and Handling of Dangerous Goods 2013," which provides practical guidance to manufacturers and suppliers of dangerous goods and occupiers storing and handling dangerous goods on how to comply with the "Dangerous Goods (Storage and Handling) Regulations 2012."
• The "Occupational Health and Safety Regulations 2007" were amended to revoke a requirement for facilities that implement risk control measures to provide information, instruction, and training to employees.
• The "Dangerous Goods (Transport by Road or Rail) Amendment Regulations 2015," effective July 28, 2015, amended the "Dangerous Goods (Transport by Road or Rail) Regulations 2008" to reflect changes made to the "Federal Government’s National Transport Commission (Model Legislation – Transport of Dangerous Goods by Road or Rail) Regulations 2007." The rule also made consequential changes to the "Dangerous Goods (Explosives) Regulations 2011" and the "Dangerous Goods (Storage and Handling) Regulations 2012."
• The "Occupational Health and Safety Regulations 2007" were amended effective July 1, 2014. These changes revised definitions for Schedule 1 and 2 carcinogenic substances and for GHS, updated requirements relating to Material Safety Data Sheets, and made other amendments to requirements in the plant, construction, and licensing parts of the regulation.
• The "Radiation Safety Act 2005" was amended to add new requirements for approved security plans and approved transport security plan for high consequence sealed sources.
